ISLAMABAD, November 18: Islamabad High Court (IHC) has suspended the notification regarding appointment of Ibrar ul Haq, PTI leader as chairman Red Crescent (Hilal-e-Ahmar Pakistan.
The appointment of Ibrar ul Haq was challenged by Saeed Elahi former chairman Hilal-e-Ahmar (HA).
IHC Chief Justice (CJ) Athar Minallah took up the petition for hearing on Monday.
.the counsel for the petitioner said Dr Saeed Elahi tenure of 3 –year service as chairman HA will expire on March 9, 2020.
Attorney General (AG) said that he is referring rules rather than section of act.
Anwar Mansoor Khan said there is a difference between rules and Pakistan Red Crescent act. If president is authorized to make appointment, he is too empowered to remove any one from office. He has not challenged the notification on removal of chairman from his office.
He stated two separate notifications were issued for removal of the petitioner from his office and new appointment made on the post. It is strange that notification of new appointment on the post was received to him but notification about his removal from office could not be received .
CJ Athar Minallah remarked “ we issue notice and we will see this matter next week.
Anwar Mansoor Khan said managing body is not authorized to determine the tenure of service as three years in connection with appointment of chairman.
The court while issuing notices to federation, establishment division, Ibrar ul Haq and other stake holders on the petition filed against Ibrar ul Haq appointment as chairman Red Crescent sought written reply till November 29.
The court while issuing stay orders against appointment of Ibrar Ul Haq as chairman Red Crescent barred him from taking over charge of his office.
Chief Justice Athar Minallah remarked the notification of appointment of Ibrar Ul Haq as chairman Red Crescent will remain suspended till next hearing.
